County Commissioners meet

The Falls County Commissioners Court met at the County Courthouse in Marlin on Monday, Nov. 27, with County Judge Jay Elliott presiding. Commissioners present were Milton Albright (Pct. 1), F.A. Green (Pct. 2), Jason Willberg (Pct. 3) and Nita Wuebker (Pct. 4). 

Presently, there is no existing burn ban in Falls County. An updated order prohibiting outdoor burning was reviewed stating: “All outdoor burning is prohibited in the unincorporated area of the county for 90 days from the date of the adoption of this order, unless the restrictions are terminated earlier based on a determination made by: (1) the Texas Forest Service that drought conditions no longer exist; or (2) the Commissioners Court or the County Judge based on a determination that the circumstances that required the Order no longer exist.”  Commissioner Green moved to accept the updated order. Seconded by Commissioner Wuebker, motion carried.

In other matters, Commissioner Green moved that solar money (three years back taxes) be placed as separate line items, general and Farm to Market Lateral Roads. Seconded by Commissioner Albright, motion carried. Commissioner Wuebker moved to purchase the Pitney Bowes SendPro 2000 postage meter machine. Seconded by Commissioner Albright, motion carried. Commissioner Albright moved to accept the Memorandum of Understanding concerning communication and coordination between the Mart ISD Police Department and the Falls County Sheriff’s Office. Seconded by Commissioner Wuebker, motion carried.

Commissioner Green moved to accept a gift deed in form of land from Benjamin Dent and Walter Dent who no longer want to pay taxes. Seconded by Commissioner Albright, motion carried. The property is in the City of Marlin, County of Falls, State of Texas, Lot No. One in Block No. Seven of the Emerson and Reeves Addition. 

Due to contract possible timeframe, Gary’s TLC Moving was approved to move the museum contents to the Falls County Annex for storage during renovations and repairs of the museum. Moved by Commissioner Green and seconded by Commissioner Albright, motion carried.  

Due to the holiday, Commissioner Albright moved to change the Dec. 26 meeting to Dec. 22.  Seconded by Commissioner Willberg, motion carried. In modifying the payroll, Commissioner Albright moved to change payroll to Dec. 22. Seconded by Commissioner Wuebker. Motion carried.

The commissioners discussed amending the existing Tax Abatement Agreement between Enel Green Power Roseland Solar, LLC (f/k/a Hecate Energy Roseland Solar, LLC. Another concern is the battery storage safety procedures for the solar-powered electric generation facility.  Commissioner Albright moved to offer in the agreement 60/40 -10 years plus $50K. Seconded by Commissioner Willberg, motion carried. 

Jeff Jackson, Road & Bridge Administrator, noted because of the previous weather conditions, the department is trying to get caught up. Commissioner Albright moved to approve payment of bills, budget amendments and payroll. Seconded by Commissioner Green, motion carried. Commissioner Wuebker moved to approve the Nov. 14, 2022, minutes. Seconded by Commissioner Albright, motion carried. With no further agenda items, Judge Elliott adjourned the meeting.
