A Regular Meeting of the Marlin City Council was held Tuesday, February 11, 2026, at 6 pm, Mayor Susan Byrd presiding. Council members present were Terence McDavid, William Roe, Cecil Sparks, Joe Mark Taylor, and Morris Watson, Jr. Council member Scottie Henderson was not in attendance. The minutes of the regular January 13, 2026 meeting and Special Called January 15, 2026 meeting were approved.
City Manager Jason Creacy provided financial and operational updates. Collections are progressing in the Water Department. A Certificate of Deposit (CD) was used to purchase an electric mobile water plant which will be used for about eighteen months. Citizens are encouraged to conserve water usage and will be on water boil notice. Complaints regarding trash collection concerns are being addressed. An interlocal agreement to assist with lawncare is being considered.
Police Chief Hommel presented a breakdown of service calls. Information on the Uvalde Strong Act House Bill 33 will be updated. He noted the Racial Profiling Report was completed and filed with the State. More info will be shared regarding the HB 33 module.
Fire Chief Justin Parker corrected the January 2026 report to include 79 emergency responses. Several firework fires occurred. Due to the abnormally dry status, citizens were advised to be careful. Parker recognized the J & K Warming Center for providing ninety-six round the clock hours of shelter during the freeze.
Updates on Texas Water Development Board (TWDB), Clean Water State Revolving Fund & Drinking Water State Revolving Fund Projects from the MRB Group were summarized. A meeting is planned with the contractor to oversee completions. Presently, no curbing is available on the north side of First Street. A report on the proposed filter project was shared. A review of funding received 1981-closing date. Gill explained the process of checks and balances of funding. It was noted Marlin ranked favorably for two $5 million dollar Water Supply and Infrastructure Grants. Additional info will follow.
Reported by the City Attorney, as ordinance calling for the 2026 general election and waiver of first reading, Precincts 2,4, and 6 positions will expire in May 2026. The deadline to apply to run for these precincts is 5 pm, February 13. Falls County will conduct the city election. As a reminder, Pcts. 2,4,6 elections are on even numbered years and Pcts. 1,3, 5 and mayor, odd number years. A Special Election for proposed charter amendments and waiver of first reading was discussed. Councilman Roe moved to accept propositions as a whole, seconded by Councilman Watson, the motion carried.
The Council discussed the appointment or retention of a Municipal Judge, a two-year contract. Mayor Byrd will put out a Request for Proposal. Following a public hearing, the Council voted to amend the fee appendix to the Code of Ordinances for building, development & zoning related fees by 20%. An additional fee may be applied if working without proper permits.
The Council recessed at 7:27 pm from the open meeting and reconvened in executive session for Attorney Consultation, Real Property, Personnel Matters, and Economic Development to deliberate and seek legal advice on the following matters: City Council legal obligations, Chief of Police Employment, Falls County Youth Fair Lease, Big Tex Tar & Chip, economic incentives for Circle T Truck Stop, and Chapter 9 of the Texas Govt. Code related to the City Charter amendments. The Council reconvened to open session at 8:19 pm. A resolution for a three-year term for Police Chief Hommel will be Dec. 2025 to Dec. 2028.
